Terms and Conditions

1. Introduction

1.1. Sakr Stores is a specialized e-commerce platform for home supplies, decorations, and all elements related to smart homes. It enables users from commercial entities to list and sell products and allows companies and individuals to purchase and shop for a wide variety of distinguished products.

1.2. These general terms and conditions apply to both sellers and buyers on the Sakr Stores website and govern your use of Sakr Stores and any related services.
By using Sakr Stores, you acknowledge your full acceptance of these general terms and conditions. If you do not agree with all or part of these terms, you must not use the Sakr Stores platform.

1.3. If you are using Sakr Stores while engaged in business or other organizational activities, you acknowledge the following:

·        1.3.1. You have the necessary authority to agree to these terms and conditions;

·        1.3.2. You ensure that you and the individual, corporate, or legal entity operating your business or project are bound by these general terms and conditions;

·        1.3.3. You agree that the pronoun "you" refers to the individual user and/or the company or legal entity, unless otherwise required;

·        1.3.4. A customer is not allowed to create more than one account on the platform. If multiple accounts are created, the company reserves the right to suspend or ban the additional accounts.

2. Registration and Account

You may register as a buyer or seller and benefit from the services if you meet the legal eligibility criteria that allow you to act and transact, as follows:

2.1. For Buyers:

·        2.1.1. You must be of legal age to purchase products.

·        2.1.2. You must be a mature adult responsible for your actions and conduct.

·        2.1.3. You must be able to provide a valid delivery address within the Arab Republic of Egypt.

·        2.1.4. You must have a valid email address.

·        2.1.5. You must own a phone line registered with a telecommunications company in Egypt.

2.2. For Sellers:

·        2.2.1. You must have a legally registered business in accordance with applicable Egyptian laws.

·        2.2.2. You must hold a valid commercial license.

·        2.2.3. You must provide evidence of ownership of the products to be listed and proof of authorization to use the product’s brand name.

·        2.2.4. You must be able to provide proof of authorization for individuals registering or using the site on behalf of the business.

·        2.2.5. Proof of identity for the authorized individual must be provided.

·        2.2.6. Bank account details must be provided.

·        2.2.7. You acknowledge and agree that additional requirements may apply for certain product categories.

2.3. To register on the site, you must provide certain information. Your registration will not be accepted if you fail to provide the required details.

2.4. We reserve the right to reject any registration without providing reasons.

2.5. We may perform verification checks to confirm your identity and eligibility.

2.6. Once registered successfully, your account remains valid for an indefinite period unless suspended or terminated under the provisions of these terms.

3. Terms and Conditions of Sale

You acknowledge and agree that:

3.1. Sakr Stores is an e-commerce platform where sellers list their products and buyers purchase them. Sakr Stores accepts binding sales transactions on behalf of the sellers but is not a party to the transaction between buyer and seller.

3.2. A binding sales contract is formed between the seller and buyer upon purchase confirmation by the buyer through Sakr Stores, and both parties are obligated to fulfill the transaction.

3.3. The sales contract is governed by the seller's terms of business and the following conditions:

·        3.3.1. The product is sold at the listed price.

·        3.3.2. The price includes all applicable taxes in accordance with local regulations.

·        3.3.3. Delivery, packaging, transportation, administrative, insurance, and any additional fees are payable by the buyer only if clearly listed in the product details.

·        3.3.4. Products must be of satisfactory quality, safe, suitable for the described purpose, and match all specifications listed.

·        3.3.5. The seller confirms legal ownership and the right to sell or supply the product, whether physical or digital, free of third-party claims or legal restrictions.

·        3.3.6. The seller must clearly disclose any applicable product terms, warranties, and necessary conditions for proper usage in the product description.

4. Warranties, Representations, and Declarations

You warrant, represent, and confirm that:

1.     You fully comply with applicable Egyptian laws, including but not limited to privacy laws, content regulations, and consumer protection laws.

2.     You have full authority to enter into this agreement and are not violating any laws or regulations.

3.     Listing your products does not create any partnership or contractual relationship between the platform and any third party you may be contracted with.

4.     If registering or using the platform on behalf of a company, you are authorized to do so, and the account belongs to the company.

5.     You are the owner or authorized licensor of all rights granted to us under these terms.

6.     Any content you submit does not infringe on third-party rights, including intellectual property or trademarks.

7.     Services are provided "as is" with no guarantees or warranties of any kind, express or implied, including but not limited to merchantability, fitness for purpose, non-infringement, or uninterrupted service.

8.     We strive for accuracy but do not guarantee that product descriptions or content are error-free, complete, or current. Buyers agree not to hold us liable for third-party content. Sellers are responsible for the accuracy of their product listings.

5. Liability and Indemnification

5.1. Nothing in these terms limits or excludes liability for:

·        5.1.1. Fraud, including misrepresentation.

·        5.1.2. Death or personal injury caused by negligence.

·        5.1.3. Any liability that cannot be excluded under applicable law.

5.2. Under no circumstances shall we or our affiliates be liable for:

·        Loss of profits

·        Data loss

·        Business interruption

·        Financial losses

·        Indirect, incidental, or special damages

5.3. We are not liable for damages resulting directly or indirectly from:

·        Your content

·        Your inability to use the services

·        Pricing, shipping, or platform-provided guidance

·        Service delays or interruptions

·        Viruses or harmful software

·        Service inaccuracies or faults

·        Damage caused by products sold on the site

·        Actions or inactions of other users

·        Suspension of your account

·        Search ranking or visibility of listings

·        Changes to platform policies

5.4. You agree to indemnify us and our affiliates from any losses, damages, legal costs, or third-party claims arising from:

·        Use of the platform

·        Violation of these terms

·        Breach of applicable law

·        Infringement of intellectual property, defamation, or violation of others’ rights

6. Suspension, Termination, or Cancellation

We reserve the right, without liability, to limit, suspend, or revoke your access to services, cancel orders, or remove your content at our sole discretion. Payments made for canceled orders will be refunded.

7. General Provisions

7.1. Governing Law: These terms are governed by the laws of the Arab Republic of Egypt.

7.2. Dispute Resolution: Contact us in case of service issues. Any dispute shall be resolved before Egyptian courts.

7.3. Third-Party Rights: These terms do not grant rights to non-parties.

7.4. Relationship of Parties: Nothing herein creates a partnership or agency; parties remain independent entities.

7.5. Further Assurances: Parties shall take all necessary actions to enforce and uphold these terms.

7.6. Assignment: You may not transfer any rights or obligations without written consent from us.

7.7. Entire Agreement: These terms constitute the entire agreement and override any prior verbal or written arrangements.

7.8. Amendments: We reserve the right to update these terms. Continued use after changes implies acceptance.

7.9. Force Majeure: Neither party is liable for delays or failures caused by uncontrollable events (e.g., natural disasters, governmental actions, labor strikes).

7.10. No Waiver: Failure to enforce any part does not constitute waiver of others unless expressly stated in writing.

7.11. Survival: Any provisions that by nature should survive termination will remain in effect after account suspension or termination.

8. Assignment

8.1. You agree that Sakr Stores may assign or subcontract its rights and obligations under these terms.

8.2. You may not assign or transfer your rights without prior written consent from Sakr Stores.
